Terms of Use

1. Acceptance of Terms

By downloading, installing, registering for, or otherwise accessing the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference into this Agreement.

If you are using the Service on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms, and that "you" refers to both you individually and that organisation.

Changes to these Terms, including notice and any required acceptance, are described in Section 21.

2. Description of the Service

Estroclic helps adults organize their contraceptive pill routine and the health information they choose to record. The app offers:

• Daily pill reminders and notification controls
• Pill and pack records, calendar history, and withdrawal-bleed logging
• Optional symptom, check-in, and pill-issue records
• Personal summaries and trends based on recorded information, with PDF reports available through Premium

Feature access depends on your plan, as described in Section 5. Our website also provides general educational articles, pill references, and organizational tools.

3. Eligibility

You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that:

• You are 18 years of age or older
• You have the legal capacity to enter into a binding contract in your jurisdiction
• You are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country
• All registration information you submit is accurate and truthful

If we discover that a user is under 18, we will immediately terminate their account and delete all associated personal data in accordance with our Privacy Policy and applicable law.

4. Account Registration & Security

To use the app, you must create an account using email and password or an available Apple or Google sign-in option. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security and confidentiality of your password and account credentials
• Notify us immediately of any actual or suspected unauthorised access to your account at support@estroclic.com
• Accept responsibility for all activity that occurs under your account, whether or not authorised by you
• Not share your account with any third party or permit others to access the Service through your credentials
• Not create multiple accounts for the same individual or create accounts using automated means

We are not liable for any loss or damage arising from your failure to maintain the security of your account credentials.

5. Subscriptions, Payments & Refunds

Free Plan

The Free plan includes daily reminders, notification controls, and withdrawal-bleed logging. Account deletion, privacy controls, and account-data export do not require Premium.

Premium Subscription and Trials

Premium provides additional tracking and review features, including calendar history, symptom and check-in records, personal summaries and trends, and PDF reports. These summaries organize your records; they are not medical predictions. Account-data export, including JSON export, is separate from Premium PDF reports.

Subscriptions are available as Monthly or Yearly plans. The applicable price, currency, billing period, and any taxes are shown in the app-store purchase confirmation before you subscribe.

Where an eligible trial is offered, it provides full Premium access for the trial period shown at checkout. The offer explains when billing starts and the subscription price after the trial. A trial linked to an auto-renewing subscription converts to a paid subscription unless cancelled by the deadline shown by the store.

Billing and Auto-Renewal

Subscriptions are billed through Apple or Google and renew automatically unless cancelled under the applicable store's terms. Check the store's subscription screen for your next billing date and cancellation deadline. For Apple trials, cancel at least 24 hours before the trial ends if you do not want to renew.

Price Changes

Subscription prices may change. Changes to an existing subscription follow the applicable app store's notice and consent requirements and applicable law. The store will communicate the new price and any action required. Where your consent is required, failure to cancel does not replace that consent.

Cancellation

You can manage or cancel your subscription through the store where you purchased it:

• Android: Google Play Store > profile icon > Payments & subscriptions > Subscriptions > Estroclic.
• iOS: Settings > your name > Subscriptions > Estroclic.

Cancellation normally stops the next renewal, with paid access continuing until the end of the paid period. Trial access may end when you cancel, depending on the store's terms. Deleting the app or your Estroclic account does not cancel your store subscription.

Refunds and Consumer Rights

Refund eligibility is governed by the applicable store's rules and your mandatory consumer rights. Cancellation does not automatically result in a refund for unused time. Nothing in these Terms limits a refund, withdrawal, or other remedy required by law.

For Apple purchases, request a refund through Apple's refund service. For Google Play purchases, use Google Play's refund process. You can also contact support@estroclic.com for help.

Payment Processing

Purchases are subject to the applicable Apple Media Services Terms or Google Play terms. We use a service provider to verify subscription status. BeeDazl LLC does not directly process or store your payment card details.

6. Licence to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable, personal licence to download, install, and use the Estroclic application on your personal mobile device(s) solely for your personal, non-commercial use.

This licence does not include any right to:

• Sublicense, sell, resell, transfer, assign, or commercially exploit the Service
• Modify, adapt, translate, or create derivative works of the Service
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service
• Use the Service in any manner not expressly permitted by these Terms

All rights not expressly granted herein are reserved by BeeDazl LLC.

7. Acceptable Use & Prohibited Conduct

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service in violation of any applicable local, national, or international law or regulation
• Attempt to gain unauthorised access to any part of the Service, its servers, databases, or connected systems
• Use automated bots, scrapers, crawlers, or similar tools to access the Service
• Interfere with, disrupt, or impose an unreasonable load on the Service or its infrastructure
• Introduce malware, viruses, trojan horses, or any other malicious code into the Service
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Circumvent any technological measures designed to protect the Service or restrict access to any part of it
• Use the Service to compile data in a manner that could be used by a competing product or service
• Transmit spam, chain letters, phishing messages, or any other unsolicited commercial communications through the Service
• Upload or transmit content that is unlawful, defamatory, obscene, hateful, or that infringes any third-party rights
• Attempt to access another user's account or data

Violation of this section may result in immediate suspension or termination of your account and, where appropriate, referral to law enforcement authorities.

8. Medical Disclaimer & No Medical Advice

Recording an event or viewing a summary does not establish whether your pill was absorbed or whether you are protected against pregnancy. The Service does not:

• Guarantee contraceptive effectiveness or protection against pregnancy or sexually transmitted infections
• Assess the individual effect of missed pills, vomiting, diarrhoea, or medicine interactions on your contraceptive protection
• Provide a personalized diagnosis, treatment plan, or dosing decision

Our website may explain general guidance about missed pills, side effects, and related topics. Always read the patient information leaflet for your specific medicine and consult a qualified healthcare professional for decisions about your contraception or health. Do not delay medical care because of a reminder, record, article, or summary.

Reminders depend on your device and settings and may be delayed or missed. You remain responsible for following your prescribed pill schedule. If you believe you are experiencing a medical emergency, contact local emergency services immediately.

9. Sensitive Health Data & Consent

The app processes the account and health information you choose to provide, which may include pill and pack records, bleeding, symptoms, check-ins, and notes. Our Privacy Policy explains the information involved, purposes, service providers, retention, and your choices.

Agreeing to these Terms or entering information does not by itself replace any specific consent required by applicable law. Sensitive health information may require an additional legal condition, as explained in the Privacy Policy.

Where processing relies on consent, you may withdraw it by contacting support@estroclic.com. You may also delete your account in the app. Withdrawal does not affect processing that was lawful before withdrawal; we may be unable to provide features that require the information concerned.

We do not sell personal information for money or send your entered health records as advertising events. See the Privacy Policy for details of service-provider disclosures, measurement, and applicable opt-out rights.

10. GDPR Rights (EU / EEA / UK Users)

If you are located in the European Union, European Economic Area, or United Kingdom, you have the following rights under the GDPR and UK GDPR, in addition to the rights described in our Privacy Policy:

• Right of Access (Art. 15 GDPR): obtain confirmation of whether we process your data and receive a copy of it
• Right to Rectification (Art. 16 GDPR): request correction of inaccurate personal data
• Right to Erasure / Right to be Forgotten (Art. 17 GDPR): request deletion of your personal data where it is no longer necessary for the purposes collected, where you withdraw consent, or where processing is unlawful
• Right to Restriction of Processing (Art. 18 GDPR): request that we restrict processing of your data while accuracy or lawfulness is being contested
• Right to Data Portability (Art. 20 GDPR): receive your data in a structured, commonly used, machine-readable format and transmit it to another controller
• Right to Object (Art. 21 GDPR): object at any time to processing based on legitimate interests
• Right to Lodge a Complaint: file a complaint with your national Data Protection Authority or, in the UK, the Information Commissioner's Office (ICO) at ico.org.uk

To exercise your GDPR rights, email support@estroclic.com. We will respond within 30 days. Nothing in these Terms limits your rights as a consumer under the mandatory laws of your EU member state.

11. CCPA Rights (California Users)

Where the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), applies, California residents may have the following rights, subject to the conditions and exceptions in that law:

• Right to Know: request disclosure of the categories and specific pieces of personal information collected, the sources, the business purposes, and the categories of third parties with whom it is shared
• Right to Delete: request deletion of personal information we have collected from you, subject to certain exceptions
• Right to Correct: request correction of inaccurate personal information
• Right to Opt Out of Sale/Sharing: request to opt out where applicable law provides this right; see our Privacy Policy for the distinction between selling information for money and broader legal definitions of sale or sharing
• Right to Limit Use of Sensitive Personal Information: direct us to use sensitive personal information (health data) only for operating the Service
• Right to Non-Discrimination: we will not discriminate against you for exercising your CCPA rights

To submit a CCPA request, email support@estroclic.com with "CCPA Rights Request" in the subject line. We will verify your identity and respond within 45 days.

12. Intellectual Property

The Service and all of its content, including the Estroclic name, logo, visual design, application code, user interface, icons, graphics, text, and all other materials, are owned by or licensed to BeeDazl LLC and are protected by copyright, trademark, trade secret, and other intellectual property laws of the United States and applicable foreign jurisdictions.

You may not use the Estroclic name, logo, or any other proprietary materials without our prior written consent. Requests may be sent to support@estroclic.com.

Any unauthorised use, reproduction, distribution, modification, or public display of the Service's content constitutes copyright infringement and may subject you to civil and criminal penalties.

13. User Feedback & Submissions

If you send us product ideas or suggestions, you give BeeDazl LLC permission to use and adapt those ideas to develop and improve the Service without paying you or crediting you. We are not obligated to use a suggestion.

This permission does not authorize publication of your personal information, health records, or support attachments. We handle those materials as described in our Privacy Policy.

14. Third-Party Services, Links & Sub-Processors

We use service providers for functions such as hosting, account services, subscription verification, communications, and measurement. Our Privacy Policy explains how providers handle personal information. Purchases and optional Apple or Google sign-in are also subject to the relevant provider's terms.

The Service may link to third-party websites or resources. Their content, terms, and privacy practices are governed by their respective operators.

15. Disclaimer of Warranties

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In such jurisdictions, our warranties are limited to the minimum scope and duration permitted by applicable law.

16. Limitation of Liability

Our total aggregate liability to you for all claims arising from or related to these Terms or the Service shall not exceed the greater of: (a) the total amount you paid to BeeDazl LLC in the 12 months immediately preceding the event giving rise to the claim; or (b) $100 USD.

If you are a consumer in the EU/EEA or UK, nothing in these Terms limits BeeDazl LLC's liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any liability that cannot be excluded or limited under applicable mandatory consumer protection law.

17. Indemnification

You agree to defend, indemnify, and hold harmless BeeDazl LLC, its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use or misuse of the Service
• Your violation of any third-party right, including intellectual property rights or privacy rights
• Any content or information you submit through the Service
• Your violation of any applicable law or regulation

18. Termination

Termination by You: You may terminate your account and these Terms at any time by selecting "Delete Account" in the app or by emailing support@estroclic.com. Upon account deletion, we will delete your personal data in accordance with our Privacy Policy, subject to the legal exceptions described there. Deleting your account does not cancel an Apple or Google subscription; cancel it separately through the relevant store.

Inactive Accounts: We periodically delete accounts when there has been no sign-in and no pill-history entry for more than two years. For accounts that have never signed in, we use the account creation date. See our Privacy Policy for retention details.

Termination by Us: We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, including but not limited to cases where we believe you have violated these Terms or engaged in conduct harmful to other users, to us, or to third parties. We will provide notice where practicable.

Effect of Termination: Upon termination, your right to use the Service ceases immediately. Sections 7, 9, 13, 14, 16, 17, 18, 21, and 23 of these Terms survive termination.

Paid Subscriptions: If we terminate your account without cause, we will refund any prepaid fees for the unused portion of your current subscription period. If termination is due to your violation of these Terms, refund eligibility remains subject to applicable law and the relevant store's rules.

19. Changes to the Service

We reserve the right to modify, suspend, or discontinue the Service, or any feature or part thereof, at any time at our sole discretion, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may also add new features, impose usage limits, or change the structure of the Service. Where such changes materially affect paid subscribers, we will provide advance notice.

20. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Dispute Resolution Process

Before initiating formal legal proceedings, you agree to attempt to resolve any dispute with us informally by contacting support@estroclic.com with a written description of the dispute. We will attempt to resolve the issue within 30 days of receipt.

Binding Arbitration

If the dispute cannot be resolved informally, any claim arising from or relating to these Terms or the Service shall be resolved by binding arbitration in the State of Wyoming, USA, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitrator's decision shall be final and binding.

Class Action Waiver

You and BeeDazl LLC each waive the right to bring any claims as a class action, collective action, or representative action. All disputes must be resolved on an individual basis only.

EU / EEA / UK Consumer Rights

If you are a consumer located in the EU, EEA, or UK, nothing in this section affects your right to bring a claim before the courts of your country of habitual residence or to exercise your rights under the mandatory consumer protection laws of your country.

Time Limitation

Any cause of action arising from or relating to these Terms or the Service must be commenced within one (1) year after the cause of action accrues. After this period, the claim is permanently barred.

21. Changes to These Terms

We may update these Terms as the Service or applicable requirements change. We will post the revised Terms on this page and update the date above.

For material changes, we will provide notice through an appropriate channel, such as the website, app, or email, with any advance notice and acceptance required by applicable law. Continued use does not replace express acceptance where it is required.

If you do not agree to revised Terms, you may stop using the Service and delete your account. Cancel any store subscription separately as explained in Section 5. Nothing in this section limits your mandatory consumer rights.

22. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and BeeDazl LLC regarding the Service and supersede all prior agreements, representations, and understandings.

Severability: If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Waiver: No failure or delay by BeeDazl LLC in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy. Any waiver must be in writing and signed by an authorised representative of BeeDazl LLC.

Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

Force Majeure: We will not be liable for any delay or failure to perform our obligations under these Terms to the extent caused by events beyond our reasonable control, including but not limited to natural disasters, acts of government, cyberattacks, power outages, or third-party service failures.

No Partnership: Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and BeeDazl LLC.

Notices: Notices from us to you will be delivered via email to the address associated with your account or via in-app notifications. Notices from you to us must be sent to support@estroclic.com.
