Terms of Use

1. Acceptance of Terms

By downloading, installing, registering for, or otherwise accessing the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference into this Agreement.

If you are using the Service on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms, and that "you" refers to both you individually and that organisation.

We reserve the right to update or modify these Terms at any time. Your continued use of the Service after any such modification constitutes your acceptance of the revised Terms. We will notify you of material changes as described in Section 22.

2. Description of the Service

Estroclic is a contraceptive pill tracking and reminder application designed exclusively for individuals who use hormonal contraceptives. The Service enables you to:

• Set up and manage a daily pill reminder schedule based on your pill type (combined, progestin-only, or extended cycle)
• Log daily pill-taking activity and maintain a personal pill history
• Track your streak, cycle position, and days remaining in your current pack
• View your cycle history on a visual calendar
• Access Premium features via a paid subscription, including full calendar history, cycle insights, absorption and symptom tracking, health report PDF export, pill brand information, placebo tracking, and timezone-aware reminders

3. Eligibility

You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that:

• You are 18 years of age or older
• You have the legal capacity to enter into a binding contract in your jurisdiction
• You are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country
• All registration information you submit is accurate and truthful

If we discover that a user is under 18, we will immediately terminate their account and delete all associated personal data in accordance with our Privacy Policy and applicable law.

4. Account Registration & Security

To access core features of the Service, you must create an account by providing a valid email address and password. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security and confidentiality of your password and account credentials
• Notify us immediately of any actual or suspected unauthorised access to your account at support@estroclic.com
• Accept responsibility for all activity that occurs under your account, whether or not authorised by you
• Not share your account with any third party or permit others to access the Service through your credentials
• Not create multiple accounts for the same individual or create accounts using automated means

We are not liable for any loss or damage arising from your failure to maintain the security of your account credentials.

5. Subscriptions, Payments & Refunds

Free Plan

Estroclic offers a Free plan providing access to core features including daily reminders, streak tracking, and cycle calendar. The Free plan is provided at no cost and may be used indefinitely, subject to these Terms.

Premium Subscription

Estroclic Premium unlocks advanced features including detailed adherence analytics, symptom tracking, predictive insights, and health report exports. Premium is available at the following pricing tiers:

• Monthly: $6.99 USD per month, billed monthly
• Annual: $39.99 USD per year, billed annually (equivalent to $3.33/month)

Prices are displayed in USD. Actual pricing may vary by region as determined by the applicable app store platform (Google Play for Android; App Store for iOS).

Billing & Auto-Renewal

Subscriptions are billed in advance on a recurring basis at the start of each billing period. Your subscription will automatically renew at the end of each period unless cancelled at least 24 hours before the renewal date.

Price Changes

We reserve the right to modify subscription pricing. If we change the price of your active subscription, we will provide at least 30 days' advance notice by email. If you do not cancel before the new price takes effect, you agree to the updated pricing.

Cancellation

You may cancel your subscription at any time through the app store platform on your device:

• Android: Open the Google Play Store → tap your profile icon → Payments & subscriptions → Subscriptions → Estroclic → Cancel subscription.
• iOS: Open iPhone Settings → tap your name → Subscriptions → Estroclic → Cancel Subscription. Alternatively, open the App Store → tap your profile picture → Subscriptions → Estroclic → Cancel.

Upon cancellation, you will retain full access to Premium features until the end of your current billing period. Cancellation does not entitle you to a prorated refund for unused time within a paid period.

Refunds

All subscription fees are generally non-refundable, except where required by applicable consumer protection law. If you believe you are entitled to a refund under applicable law, please contact us at support@estroclic.com within 14 days of the charge. EU consumers are reminded that the 14-day statutory cooling-off right for digital services may apply unless the service has been fully performed with your prior consent. For iOS purchases, refund requests must be submitted directly to Apple at reportaproblem.apple.com, as BeeDazl LLC does not control Apple's billing system.

Payment Processing

Subscriptions are processed through the applicable app store platform on your device:

• Android: Google Play Billing (Google LLC). Your purchase is subject to Google Play's payment terms.
• iOS: Apple In-App Purchase (Apple Inc.). Your purchase is subject to Apple's Media Services Terms and Conditions.

Subscription management and cross-platform entitlement verification are handled by a third-party subscription management provider on our behalf. BeeDazl LLC does not process or store your payment card data directly. For billing issues, manage your subscription through the relevant app store on your device, or contact us at support@estroclic.com.

6. Licence to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable, personal licence to download, install, and use the Estroclic application on your personal mobile device(s) solely for your personal, non-commercial use.

This licence does not include any right to:

• Sublicense, sell, resell, transfer, assign, or commercially exploit the Service
• Modify, adapt, translate, or create derivative works of the Service
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service
• Use the Service in any manner not expressly permitted by these Terms

All rights not expressly granted herein are reserved by BeeDazl LLC.

7. Acceptable Use & Prohibited Conduct

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service in violation of any applicable local, national, or international law or regulation
• Attempt to gain unauthorised access to any part of the Service, its servers, databases, or connected systems
• Use automated bots, scrapers, crawlers, or similar tools to access the Service
• Interfere with, disrupt, or impose an unreasonable load on the Service or its infrastructure
• Introduce malware, viruses, trojan horses, or any other malicious code into the Service
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Circumvent any technological measures designed to protect the Service or restrict access to any part of it
• Use the Service to compile data in a manner that could be used by a competing product or service
• Transmit spam, chain letters, phishing messages, or any other unsolicited commercial communications through the Service
• Upload or transmit content that is unlawful, defamatory, obscene, hateful, or that infringes any third-party rights
• Attempt to access another user's account or data

Violation of this section may result in immediate suspension or termination of your account and, where appropriate, referral to law enforcement authorities.

8. Medical Disclaimer & No Medical Advice

The Service does not:

• Guarantee contraceptive effectiveness or protection against pregnancy or sexually transmitted infections
• Account for interactions with other medications, vomiting, diarrhoea, or antibiotics that may reduce contraceptive efficacy
• Provide guidance on what to do if you miss a pill, consult your prescribing healthcare provider or the package insert for your specific medication
• Diagnose, treat, cure, or prevent any medical condition

You should always consult a qualified healthcare professional regarding your contraceptive method, any changes to your health, missed pills, side effects, or any medical concerns. Do not disregard professional medical advice or delay seeking it based on information from the Service.

If you believe you are experiencing a medical emergency, call your local emergency services immediately.

BeeDazl LLC expressly disclaims all liability for health outcomes arising from reliance on or use of the Service, including but not limited to unintended pregnancy resulting from missed pills or notification failures.

9. Sensitive Health Data & Consent

The Service collects and processes sensitive personal health information, specifically your contraceptive pill type, cycle schedule, and daily pill-taking history. Under applicable law, including the EU General Data Protection Regulation (GDPR), this constitutes "special category" personal data requiring explicit consent.

By completing the onboarding flow and entering your cycle information, you provide explicit, freely given, specific, informed, and unambiguous consent to our processing of this data for the sole purpose of operating the Service as described in our Privacy Policy.

You may withdraw this consent at any time by deleting your account. Withdrawal does not affect the lawfulness of processing based on consent before its withdrawal. Please note that withdrawal of consent for health data processing will prevent us from providing the core pill tracking features.

We will never sell, share, or use your health data for advertising, insurance, employer reporting, or any purpose beyond operating the Service for you personally.

10. GDPR Rights (EU / EEA / UK Users)

If you are located in the European Union, European Economic Area, or United Kingdom, you have the following rights under the GDPR and UK GDPR, in addition to the rights described in our Privacy Policy:

• Right of Access (Art. 15 GDPR): obtain confirmation of whether we process your data and receive a copy of it
• Right to Rectification (Art. 16 GDPR): request correction of inaccurate personal data
• Right to Erasure / Right to be Forgotten (Art. 17 GDPR): request deletion of your personal data where it is no longer necessary for the purposes collected, where you withdraw consent, or where processing is unlawful
• Right to Restriction of Processing (Art. 18 GDPR): request that we restrict processing of your data while accuracy or lawfulness is being contested
• Right to Data Portability (Art. 20 GDPR): receive your data in a structured, commonly used, machine-readable format and transmit it to another controller
• Right to Object (Art. 21 GDPR): object at any time to processing based on legitimate interests
• Right to Lodge a Complaint: file a complaint with your national Data Protection Authority or, in the UK, the Information Commissioner's Office (ICO) at ico.org.uk

To exercise your GDPR rights, email support@estroclic.com. We will respond within 30 days. Nothing in these Terms limits your rights as a consumer under the mandatory laws of your EU member state.

11. CCPA Rights (California Users)

If you are a California resident, the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA) afford you specific rights regarding your personal information:

• Right to Know: request disclosure of the categories and specific pieces of personal information collected, the sources, the business purposes, and the categories of third parties with whom it is shared
• Right to Delete: request deletion of personal information we have collected from you, subject to certain exceptions
• Right to Correct: request correction of inaccurate personal information
• Right to Opt Out of Sale/Sharing: we do not sell or share personal information, this right is honoured as a matter of policy
• Right to Limit Use of Sensitive Personal Information: direct us to use sensitive personal information (health data) only for operating the Service
• Right to Non-Discrimination: we will not discriminate against you for exercising your CCPA rights

To submit a CCPA request, email support@estroclic.com with "CCPA Rights Request" in the subject line. We will verify your identity and respond within 45 days.

12. Intellectual Property

The Service and all of its content, including the Estroclic name, logo, visual design, application code, user interface, icons, graphics, text, and all other materials, are owned by or licensed to BeeDazl LLC and are protected by copyright, trademark, trade secret, and other intellectual property laws of the United States and applicable foreign jurisdictions.

You may not use the Estroclic name, logo, or any other proprietary materials without our prior written consent. Requests may be sent to support@estroclic.com.

Any unauthorised use, reproduction, distribution, modification, or public display of the Service's content constitutes copyright infringement and may subject you to civil and criminal penalties.

13. User Feedback & Submissions

If you submit feedback, suggestions, ideas, bug reports, or other communications to us regarding the Service ("Feedback"), you hereby grant BeeDazl LLC a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable licence to use, reproduce, modify, adapt, publish, distribute, and create derivative works from such Feedback for any purpose, without compensation to you.

Feedback is not confidential, and we are under no obligation to treat it as such. We are not obligated to use any Feedback you submit.

14. Third-Party Services, Links & Sub-Processors

The Service relies on third-party service providers to deliver core and auxiliary functions. Where a provider is material to how your personal data is handled, we disclose them by name below. We may update our sub-processors over time; a current and complete list is available upon written request to support@estroclic.com. Material changes that affect how your personal data is processed will be reflected in an updated Privacy Policy with advance notice as required by applicable law.

• Infrastructure & database hosting: Cloud database and backend infrastructure provider, stores your account data and cycle content on encrypted servers.
• Subscription management & entitlements: Cross-platform subscription management provider, verifies subscription status and manages entitlements across Android and iOS.
• Payment processing (Android): Google Play Billing, operated by Google LLC, processes in-app purchases on Android devices. Subject to Google Play's payment terms.
• Payment processing (iOS): Apple In-App Purchase (StoreKit), operated by Apple Inc., processes in-app purchases on iOS devices. Subject to Apple's Media Services Terms and Conditions.
• Push notification delivery: Third-party notification delivery infrastructure, delivers daily pill reminders and other push notifications to your device.

Our website or the Service may contain links to third-party websites or resources provided for your convenience only. We are not responsible for the content, data practices, or terms of any linked third-party sites, and you access them at your own risk.

15. Disclaimer of Warranties

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In such jurisdictions, our warranties are limited to the minimum scope and duration permitted by applicable law.

16. Limitation of Liability

Our total aggregate liability to you for all claims arising from or related to these Terms or the Service shall not exceed the greater of: (a) the total amount you paid to BeeDazl LLC in the 12 months immediately preceding the event giving rise to the claim; or (b) $100 USD.

If you are a consumer in the EU/EEA or UK, nothing in these Terms limits BeeDazl LLC's liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any liability that cannot be excluded or limited under applicable mandatory consumer protection law.

17. Indemnification

You agree to defend, indemnify, and hold harmless BeeDazl LLC, its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use or misuse of the Service
• Your violation of any third-party right, including intellectual property rights or privacy rights
• Any content or information you submit through the Service
• Your violation of any applicable law or regulation

18. Termination

Termination by You: You may terminate your account and these Terms at any time by selecting "Delete Account" in the app or by emailing support@estroclic.com. Upon account deletion, we will delete your personal data in accordance with our Privacy Policy, subject to retention obligations for financial records.

Termination by Us: We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, including but not limited to cases where we believe you have violated these Terms or engaged in conduct harmful to other users, to us, or to third parties. We will provide notice where practicable.

Effect of Termination: Upon termination, your right to use the Service ceases immediately. Sections 7, 9, 13, 14, 16, 17, 18, 21, and 23 of these Terms survive termination.

Paid Subscriptions: If we terminate your account without cause, we will refund any prepaid fees for the unused portion of your current subscription period. If termination is due to your violation of these Terms, no refund will be provided.

19. Changes to the Service

We reserve the right to modify, suspend, or discontinue the Service, or any feature or part thereof, at any time at our sole discretion, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may also add new features, impose usage limits, or change the structure of the Service. Where such changes materially affect paid subscribers, we will provide advance notice.

20. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Dispute Resolution Process

Before initiating formal legal proceedings, you agree to attempt to resolve any dispute with us informally by contacting support@estroclic.com with a written description of the dispute. We will attempt to resolve the issue within 30 days of receipt.

Binding Arbitration

If the dispute cannot be resolved informally, any claim arising from or relating to these Terms or the Service shall be resolved by binding arbitration in the State of Wyoming, USA, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitrator's decision shall be final and binding.

Class Action Waiver

You and BeeDazl LLC each waive the right to bring any claims as a class action, collective action, or representative action. All disputes must be resolved on an individual basis only.

EU / EEA / UK Consumer Rights

If you are a consumer located in the EU, EEA, or UK, nothing in this section affects your right to bring a claim before the courts of your country of habitual residence or to exercise your rights under the mandatory consumer protection laws of your country. EU consumers may also use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Time Limitation

Any cause of action arising from or relating to these Terms or the Service must be commenced within one (1) year after the cause of action accrues. After this period, the claim is permanently barred.

21. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last updated" date at the top of this document
• Notify you by email at least 14 days before the changes take effect
• Display an in-app notice prompting you to review the updated Terms

If you do not agree with the revised Terms, you may terminate your account before the effective date. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. The most current version of these Terms is always available at estroclic.com/terms.

22. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and BeeDazl LLC regarding the Service and supersede all prior agreements, representations, and understandings.

Severability: If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Waiver: No failure or delay by BeeDazl LLC in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy. Any waiver must be in writing and signed by an authorised representative of BeeDazl LLC.

Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

Force Majeure: We will not be liable for any delay or failure to perform our obligations under these Terms to the extent caused by events beyond our reasonable control, including but not limited to natural disasters, acts of government, cyberattacks, power outages, or third-party service failures.

No Partnership: Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and BeeDazl LLC.

Notices: Notices from us to you will be delivered via email to the address associated with your account or via in-app notifications. Notices from you to us must be sent to support@estroclic.com.
